Tail Treats terms of use

Agreement

By downloading or using Tail Treats, you accept these Terms of Use (“Terms”) in full, including the “Assumption of risk” and “Limitation of liability” sections below. If you don’t agree, please don’t use the app. These Terms form a legal agreement between you and Nibbles Kitchen (“we”, “us”, or “our”).

What Tail Treats does

Tail Treats is a curated homemade dog-treat recipe app. It surfaces recipes and flags known toxic ingredients and the allergies you enter for your dog, as a convenience. It is a planning aid — it does not replace your own judgment, your attention, or your veterinarian’s advice. It is not a medical tool or a substitute for professional veterinary care.

Not a substitute for veterinary care

Our toxic-ingredient and allergen checks are based on a curated reference list and whatever you’ve entered about your dog — they are a convenience, not a guarantee, and they can be wrong. Ingredient data can be incomplete or out of date, and we don’t know your dog’s full medical history. In particular:

• You must verify every ingredient yourself before baking or feeding it, including reading the labels on the specific products you buy. Formulations change.
• Tail Treats does not account for cross-contamination or for how a treat is prepared in your kitchen.
• Recipe and ingredient tagging may contain errors. No system is infallible; do not rely solely on the app’s filtering to decide whether a food is safe for your dog.
• Talk to your vet before introducing new foods, especially if your dog is a puppy, senior, pregnant or nursing, or has any health condition or allergy.

To the fullest extent permitted by law, we are not liable for any illness, injury, or harm to your dog arising from the use of recipes or information provided by Tail Treats.

Assumption of risk

You are solely responsible for your dog’s health, diet, and wellbeing. By using Tail Treats, you agree that: you’ll read every ingredient in every recipe before baking or feeding it; you’re responsible for knowing your dog’s allergies and medical conditions and keeping that information accurate in the app; you’re responsible for portion sizes and feeding frequency; and you assume all risk of illness, injury, or death to your dog that may result from using this app, including risk arising from errors or omissions in our content.

Subscriptions and billing

Tail Treats Premium is an auto-renewing subscription that unlocks premium features. The following terms apply:

• Free trial: a free trial may be offered to new subscribers. You won’t be charged during the trial. If you don’t cancel before it ends, your subscription begins automatically and your payment method is charged. Trial length is shown before you subscribe.
• Billing: subscriptions are billed on a recurring basis (monthly or yearly, depending on the plan) through your Apple ID at confirmation of purchase.
• Cancellation: you may cancel anytime in your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period.
• Renewals: subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• Price changes: if we change the price, Apple will notify you, and continued use after the change takes effect constitutes acceptance of the new price.
• Restoration: if you reinstall the app or switch devices, use “Restore Purchases” in the app to restore your subscription.

Apple handles billing, trial terms, and cancellation. We do not process payments directly and do not store payment information.

What you can and cannot do

You may use Tail Treats for personal, non-commercial use in your own household. You may not:

• Reverse-engineer, decompile, or attempt to extract source code from the app
• Use the app for any unlawful purpose
• Attempt to circumvent subscription verification or access paid features without a valid subscription
• Redistribute or resell the app or its recipe content

Recipe content

The recipes in Tail Treats are curated and provided for planning convenience. They are not intended for publication or redistribution outside the app. We make no warranty that recipes are nutritionally complete or suitable for any specific medical dietary requirement, and treats are by their nature only a small share of a dog’s overall diet.

Intellectual property

The Tail Treats app, its design, branding, and recipe database are owned by Nibbles Kitchen. These Terms grant you a limited, personal licence to use the app and no rights to our intellectual property beyond that.

No warranties

Tail Treats is provided “as is” and “as available,” without warranties of any kind, express or implied. We work hard to keep recipes and safety information accurate, but we don’t warrant that the app or its content is error-free, complete, or uninterrupted. Your use of the app is at your own risk.

Limitation of liability

To the maximum extent the law allows, Tail Treats and its developer are not liable for any injury, illness, or death of your dog, or for any other damages, arising from your use of the app — including reliance on recipes, ingredient data, allergen filtering, or portion calculations — even if we were advised such damages were possible. Where liability can’t be fully excluded by law, our total liability is limited to what you paid for Tail Treats Premium in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless Tail Treats and its developer from any claim, loss, or expense — including reasonable legal fees — arising from your use of the app or your violation of these Terms, including claims related to your dog’s health.

Your use and age

Tail Treats is intended for use by adults. By using the app, you confirm that you are at least 18 years old, or the age of majority in your jurisdiction.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll notify you via an in-app notice or App Store release notes before the change takes effect, and we’ll update the date above. Continued use of Tail Treats after changes are posted constitutes acceptance of the updated Terms. If you don’t agree, please stop using the app and cancel any active subscription.

Governing law

These Terms are governed by the laws of California, United States, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved in the courts of California, unless otherwise required by applicable consumer-protection law in your region.
